Tax residency in Puerto Rico
For Puerto Rico income tax purposes, an individual is generally a resident if domiciled in Puerto Rico, with a rebuttable presumption of residence when physically present in Puerto Rico for at least 183 days during the calendar year. In addition, Puerto Rico applies the “bona fide resident” standard, under which an individual is treated as a Puerto Rico resident for a taxable year only if all of the following are met: a presence test (satisfied, for example, by at least 183 days in Puerto Rico during the year; or at least 549 days over the current and two preceding years with at least 60 days in each; or being in the United States no more than 90 days during the year; or having no more than $3,000 of U.S.-source earned income and being in Puerto Rico more days than in the United States; or having no significant connection to the United States), a tax home in Puerto Rico, and a closer connection to Puerto Rico than to the United States or any foreign country, based on facts such as permanent home, location of family and personal ties, and other personal and economic connections.
