Tax residency in U.S. Virgin Islands

An individual is treated as a U.S. Virgin Islands (USVI) tax resident for a taxable year if they are a bona fide resident of the USVI for that year, which requires satisfying all three of the following: (1) a presence test met by any one of these alternatives—being present in the USVI at least 183 days during the year; being present in the USVI at least 549 days during the current year and the two preceding years with at least 60 days in each of those years; being present in the United States no more than 90 days during the year; having U.S. earned income of no more than $3,000 and being present in the USVI for more days than in the United States during the year; or having no significant connection to the United States; (2) a tax home in the USVI for the entire taxable year; and (3) a closer connection to the USVI than to the United States or any foreign country, determined by overall facts and circumstances including the location of permanent home, family, personal and economic ties, and the place where routine affairs are conducted. A day generally counts if the individual is physically present in the USVI at any time during the day, and for these rules “United States” means the 50 states and the District of Columbia and does not include the USVI.
